Clarification of Refund Conditions
All purchases of Virtual Currency, Virtual Goods, NFTs, and other digital content within the Service are final and non-refundable, except where required by applicable law. Refunds may be considered in cases of technical errors, billing discrepancies, or other specific circumstances as deemed eligible by WAGMI Games. To request a refund, contact WAGMI Games customer support at support@wagmigame.io. Refund requests will be reviewed on a case-by-case basis, and if approved, will typically be issued in the form of in-game currency or credits rather than direct financial reimbursement.
User Conduct and Community Guidelines
Code of Conduct and Prohibited Activities
You agree to engage with the Service in a respectful and positive manner that contributes to a safe and enjoyable community. Prohibited activities include, but are not limited to:
- Harassment: Any form of harassment, hate speech, discrimination, or abusive behavior towards other users, moderators, or WAGMI Games staff is strictly prohibited.
- Impersonation: Impersonating another user, public figure, or WAGMI Games employee to deceive or mislead others.
- Cheating and Exploitation: Engaging in cheating, including the use of software exploits, hacks, bots, or unauthorized third-party software, is strictly forbidden.
- Spamming: Sending repetitive, irrelevant, or inappropriate messages through chat functions, forums, or other communication channels.
Moderation and Enforcement
WAGMI Games reserves the right to monitor, moderate, and remove content or accounts that violate these guidelines. Violations may result in disciplinary action, including temporary suspensions, permanent bans, or other measures as deemed appropriate by WAGMI Games. Users will be notified of any actions taken against their accounts.
Dispute Resolution and Governing Law
Binding Arbitration Agreement
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be resolved through binding arbitration administered within Delaware in accordance with its Commercial Arbitration Rules. Arbitration will be held in the jurisdiction where WAGMI Games is headquartered, and proceedings will be conducted in English. The arbitrator's decision will be final and enforceable, with judgment entered in any court of competent jurisdiction.
Opt-Out of Arbitration
You may opt out of arbitration by sending a written notice to support@wagmigame.io within 30 days of accepting these Terms. This notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration. If you opt out, any disputes will be resolved in the courts of the jurisdiction where WAGMI Games is based.
Subscription and Automatic Renewal
If you subscribe to any paid services offered by WAGMI Games, your subscription will automatically renew at the end of each billing cycle unless canceled via your account settings before the renewal date. Renewals will be billed at the then-current rate for the same duration as the original subscription, unless otherwise specified.
Content Ownership and User-Generated Content
Ownership and Licensing of NFTs
While you may own an NFT associated with the Service, WAGMI Games retains intellectual property rights over the game's content and assets. Owning an NFT does not grant rights to copy, modify, or distribute associated content without express written permission from WAGMI Games.
